Abstract

This research aims to summarize the concepts the structural design role and duty of
National Anti-Corruption commission or NCCA and the State Audit Commission and to analyze

the impact of Constitution of the Kingdom of Thailand, B.E. 2560 (2017) and The Enactment
of the Organic Act on Counter Corruption, B.E. 2561 (2018) and the Organic Act of State Audit

, B.E. 2561 (2018) on NCCA and State Audit Commission respectively.

The researchers came across that Accordance with the promulgation of Constitution

of the Kingdom of Thailand, B.E. 2560 (2017) and The Enactment of the Organic Act on Counter
Corruption, B.E. 2561 (2018) There are few crucial development in the National Anti-Corruption
Commission or NACC as follow; the tenure term of NACC commissions has reduced from 9

years to 7 years while the number of the commission remain as before, 9 commissioners.
NCCA shall have the powers and duties to inquire into the facts, summarize the case, and

prepare a verdict to be submitted to the Senate, to inquire into the facts, summarize the case,
and prepare a verdict to be submitted to the Supreme Court of Justice’s Criminal Division for

Persons Holding Political Positions etc. The current Constitution and Organic act clearly
stipulate that the commissioner must courage, responsibility, integrity, morality and

accountability to public interest. The new Organic Act on Counter Corruption requires the
commissioners for higher attributions by specify the expertise of candidates in Economics
Accountancy Law and Public Administration. There are changes in the procedure for

commission selection, such as the selection system, the source of the selection committees
in order to avoid the political pressure from the Politicians. From these adjustments, the

researchers believe that these will bring about the more efficient to NCCA together with more
responsive to the public.

For the State Audit Commission, according to the promulgation of Constitution of the
Kingdom of Thailand, B.E. 2560 (2017) and The Enactment of the Organic Act of State Audit ,
B.E. 2561 (2018). The attribution of the State Audit Commission is elevated to be responsive,

courage, integrity, morality and accountability to public interest, be good example for public,
and has good and right attitude to carry on the assigned mission. The current statue has raised

the tenure of the commission from 6 years to 7 years in order to ensure the independent of
the commissioner. The new law also demand that the candidate foe commissioner should

hold at least 10 years experiences. The successive candidate for commissioner must obtain at
least 2 of 3 change from 3 to 4 of the remaining selection committees for easing the selection

process. Like the NCCA, There are changes in the source of the selection committees in order
to avoid the political pressure from the Politicians
