The 2017 Constitution prescribes that the Thai people have the
freedom to take any action and are protected by the Constitution as
long as they do not affect or endanger the security of the state, public
morality, or violate the rights and liberty of others. The approach has
assigned the state the role of promoting and protecting the rights and
freedoms of citizens and communities. To achieve the intentions of the
Constitution, the key is to respect and adhere to the rule of law and
socialize citizens into a culture that respects rights and freedoms, but
how can this be achieved? That is still the main challenge for this
constitution.
Issues for group discussion
1. How can the people’s rights and freedoms be guaranteed
even if they are not specified in the Constitution?
2. How can rule of law prevent the abuse of privilege in society
and ensure that everyone is equal under laws publicly made?
3. How can people be socialized to respect rights and freedoms?
4. What challenges does the state face in performing its new role
in guaranteeing rule of law and protecting the rights and
freedoms of the people?
The Fifth Challenge:
National Strategy and the Future of Thailand
The National Strategy is expected act as a “compass” to
develop the country to be sustainable, to continue national development,
and to be an approach for policy formulation and suitable policy
operation. Therefore, Article 65 of the 2017 Constitution specifies that
the government has to use the National Strategy as the framework for
policy planning to develop the country to be sustainable.
However, promoting the National Strategy as a compass is a new
challenge in Thai society. Every sector should consider how it is
