removing politicians from office but has it also reduced the public’s role
and power to combat corruption?
The new constitution mandates ethical standards for politicians,
parliamentarians, members of the independent organizations and cabinet
members. Will these ethical standards help reduce corruption?

1. The challenge of implementing constitutional mechanisms to
overcome politicians’ corruption and the impact that may
occur.
2. New powers of autonomous agencies and courts to control
the government and the effect on government stability.
3. The role and effectiveness of the public in combating
corruption under the new constitution.
4. Challenges concerning the new constitution’s mandated
standards.
The Fourth Challenge:
Protection of Rights and Freedoms and Rule of Law
Rights and freedoms are guaranteed specifically by provisions of
the Constitution. A person shall enjoy the right and freedom to perform
any act that is not prohibited or restricted by the Constitution or other
laws, and these rights and freedoms shall be protected by the
Constitution. However, Thailand has many problems regarding rights and
freedoms such as inequality in access to fundamental rights and
violation of the rights of people who are disadvantaged. The 1997
Constitution had extensive provisions in the chapter regarding rights and
freedoms of the Thai people, but in practice implementation was
incomplete and the principles were not fully achieved.
